These Terms & Conditions (“Terms”) govern your use of the CARGO Rum website and purchases made through it.
This website and the CARGO Rum online store are operated by Sydney Rum Distillery Pty Ltd (“Sydney Rum Distillery”, “we”, “us” or “our”).
By using this website or placing an order, you agree to these Terms.
1. Legal drinking age
You must be of legal drinking age in your country or jurisdiction of residence to enter this website.
Alcohol purchased through this website must not be purchased by or supplied to a person under 18 years of age where Australian law applies.
No alcohol can be sold or supplied to anyone under 18. It’s against the law.
We reserve the right to refuse or cancel an order where we reasonably believe that the purchaser or intended recipient does not satisfy applicable legal age requirements.
Proof of age may be required.

2. Australian liquor sales
Alcohol sold through this website is supplied under the applicable NSW liquor licence held by Sydney Rum Distillery Pty Ltd.

3. Products
We make reasonable efforts to ensure product descriptions, images, prices, alcohol content and other information displayed on the website are accurate.
Product packaging, presentation and other details may occasionally change. Colours and appearance may also vary depending on the device or screen used to view the website.
All products are subject to availability.
4. Prices and payment
Unless otherwise stated, prices displayed on our Australian store are in Australian dollars and include GST where applicable.
Payment must be made using one of the payment methods available at checkout.
We reserve the right to correct genuine pricing or product-information errors. If an error affects an order you have already placed, we will contact you before proceeding where appropriate.
5. Orders
Submitting an order does not necessarily mean we have accepted it.
We may decline or cancel an order where reasonably necessary, including because a product is unavailable, payment cannot be authorised, an order appears fraudulent, delivery cannot legally or practically be completed, or age requirements have not been satisfied.
If we cancel an order after payment has been received, we will refund the applicable amount.
6. Delivery
We currently deliver within Australia only.
Delivery availability, charges and estimated delivery times are displayed at checkout.
Current Australian shipping rates are:
Standard Delivery — $11
Express Delivery — $15
Free Standard Delivery on orders over $100
Shipping offers and rates may change from time to time.
Delivery estimates are indicative only and may be affected by circumstances outside our reasonable control.
You are responsible for providing accurate delivery information.
Alcohol must not be delivered or supplied in circumstances prohibited by applicable liquor laws. Delivery providers may require proof of age or refuse delivery where appropriate.
7. Returns, refunds and damaged products
Our products come with rights and guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law or other applicable law that cannot legally be excluded.
If your order arrives damaged, incorrect or otherwise has a problem, please contact us at hello@cargorum.au with your order details and, where relevant, photographs of the product.
Where you are entitled to a remedy under the Australian Consumer Law, we will provide the applicable remedy.
We are not required to provide a refund simply because you change your mind, except where we choose to do so or where required by law.
8. Responsible consumption
CARGO Rum should be enjoyed responsibly.
Information provided on this website, including cocktail recipes and serving suggestions, is intended for adults of legal drinking age.

Unless otherwise indicated, content on this website—including the CARGO name and branding, logos, product designs, photography, artwork, text and other materials—is owned by or licensed to Sydney Rum Distillery.

You must not reproduce, distribute, modify, commercially exploit or otherwise use our intellectual property without permission, except where permitted by law.

We aim to keep the website available and accurate but cannot guarantee uninterrupted or error-free operation.
The website may contain links to third-party websites. We are not responsible for the content, availability or privacy practices of those websites.
11. Liability
Nothing in these Terms excludes or limits liability, guarantees, rights or remedies that cannot lawfully be excluded or limited.
To the extent permitted by law, Sydney Rum Distillery is not responsible for losses arising from misuse of this website or circumstances outside our reasonable control.

We may update these Terms from time to time.
The Terms applicable to a purchase will be those in effect when the order is placed, subject to any rights that cannot legally be excluded.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia.
Nothing in this clause excludes any rights you may have under mandatory laws applicable to you.
